Welcome to EXAL Nail Supply. This website, located at exalnailsupply.com (including all subdomains, collectively referred to as the "Site"), is owned and operated by EXAL Nail Supply ("we," "us," or "our").

This Terms & Conditions document ("Agreement") is a legal agreement between you ("you," "your," or "user") and EXAL Nail Supply. By accessing, browsing, or using this Site, or purchasing products from us, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions outlined in this Agreement, along with our Privacy Policy, Return & Refund Policy, and Warranty Policy.

If you do not agree to these terms, please discontinue your use of this Site immediately.
 

1. Professional Use Notice & Eligibility

EXAL Nail Supply is a specialized distributor of professional salon equipment and nail supplies.

  • Target Audience: The Site is intended for use by licensed nail technicians, salon owners, beauty school students, and beauty professionals who are at least 18 years of age.

  • Binding Contract: By agreeing to these Terms, you represent that you are of legal age in your state of residence to enter into a binding contract and are authorized to make purchases for professional use.
     

2. Modifications to this Agreement

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms & Conditions by posting updates and changes to our Site. The "Effective Date" at the top of this page will indicate when the latest changes were made. Your continued use of or access to our Site following the posting of any changes constitutes acceptance of those revised terms.
 

3. User Accounts and Security

To purchase products or access certain professional-only sections of the Site, you may be required to register for an account.

  • Account Accuracy: You agree to provide accurate, current, and complete information during registration and to keep this information updated.

  • Password Security: You are solely responsible for safeguarding your account password and restricting access to your computer or mobile device. You agree to accept responsibility for all activities or purchases that occur under your account.

  • Unauthorized Access: You must notify us immediately at team@exalnailsupply.com of any unauthorized use of your account or security breach. We reserve the right to terminate accounts, refuse service, or cancel orders at our sole discretion.
     

4. Terms of Sale, Pricing, and Currency

  • Pricing & Currency: All prices on the Site are listed in US Dollars ($ USD). Prices and product availability are subject to change without notice.

  • Order Confirmation & Corrections: Receipt of an electronic order confirmation does not signify our acceptance of your order. We reserve the right to correct any typographical errors, inaccuracies, or omissions related to pricing, descriptions, or availability, even after an order has been submitted or processed.

  • Order Cancellation: We reserve the right to limit the quantity of items purchased per person, per household, or per order. We also reserve the right to refuse or cancel any order at our sole discretion (for example, if we suspect fraud or unauthorized commercial resale).

  • Taxes and Shipping: You are responsible for all sales taxes, shipping charges, and handling fees associated with your purchase, which will be calculated and displayed at checkout.
     

5. User Submissions and Reviews

  • Content Rules: You represent and warrant that your Submission does not violate any third-party copyright, trademark, privacy, or proprietary rights, and does not contain defamatory, obscene, abusive, or otherwise illegal material. We reserve the right (but have no obligation) to monitor, edit, or remove any Submission at our sole discretion.
     

6. Prohibited Uses of the Site

In addition to other prohibitions set forth in this Agreement, you are strictly prohibited from using the Site or its content:

IN NO CASE SHALL EXAL NAIL SUPPLY, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND—INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR ANY SIMILAR DAMAGES—ARISING FROM YOUR USE OF THE SITE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED, EVEN IF ADVISED OF THEIR POSSIBILITY.

13. Governing Law and Dispute Resolution

  • Governing Law: This Agreement and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of California (or the US State where your business is officially registered), without regard to its conflict of law principles.

  • Dispute Resolution (Arbitration): Any dispute, claim, or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by individual binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (AAA). The arbitration shall take place in your registered business's home state/county, and shall be conducted in English by a single neutral arbitrator.

  • Class Action Waiver: YOU AND EXAL NAIL SUPPLY AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR WE WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.
     

14. Severability

In the event that any provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions. Such determination shall not affect the validity and predictability of any other remaining provisions.
